The UK Court of Appeal has commenced a five-day hearing in the case of InterDigital vs Lenovo. The purpose of the hearing is to determine how UK patent courts calculate FRAND (Fair, Reasonable, and Non-Discriminatory) rates for past infringements and to establish the attractiveness of UK courts for SEP (Standard Essential Patent) holders. The hearing is a result of appeals from both InterDigital and Lenovo regarding a ruling by High Court judge James Mellor in March 2023. The judges presiding over the case have extensive patent litigation experience, including Colin Birss, who previously set a global FRAND rate in another case. The hearing is expected to continue until at least Thursday, and possibly until Friday. [46a5065b]
